1. Definitions
- "SkinStack," "we," "us," "our" means Van Global Ltd (Company Number 17247311), doing business as SkinStack, a private limited company registered in England and Wales.
- "Service" means the SkinStack mobile application and any related services provided by us.
- "User," "you," "your" means any individual who downloads, registers, or uses the Service.
- "AI Analysis" means the automated ingredient analysis, product scoring, alternative suggestions, and routine conflict detection provided by the Service.
- "Mel" or "Mel AI Chat" means the conversational AI feature that allows users to ask questions about scanned products and ingredients, powered by Anthropic's Claude AI.
- "Premium Subscription" means a paid subscription to access enhanced features of the Service.
2. Eligibility
You must be at least 13 years of age to use the Service. Users between 13 and 18 must have the permission of a parent or legal guardian. By using the Service, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into these Terms.
If you are 18 or over and wish to create Family Profiles for your dependants (including children under 13), you accept full responsibility for those profiles. You confirm you have the appropriate parental or guardian authority to provide your dependant's skin information. We will process that data solely to personalise AI analysis for that family member.
3. Account Registration
To access most features of the Service, you must register for an account. When registering, you agree to provide accurate, current, and complete information and to maintain the security of your account. We use email one-time passcodes (OTP) for authentication. We do not store passwords.
4. Description of Service
SkinStack is an AI-powered skincare product scanner and skin guide. The Service allows you to:
- Photograph skincare product ingredient labels and receive AI-powered analysis
- Receive personalised ingredient assessments based on your skin profile (skin type, concerns, sensitivity, country)
- Discover better-matched alternative products with similar active ingredients, personalised to your skin profile
- Detect potential conflicts between products in your skincare routine
- Save and manage your personal skincare routine, product shelf, wishlist, and products to avoid
- Chat with Mel, our AI skin guide, for ingredient and product questions related to your most recently scanned product
- Create Family Profiles to scan products on behalf of dependants, with age-appropriate AI analysis
- Receive weather-aware skin notifications (requires notification and approximate location permission)
5. Important AI Disclaimer — Not Medical Advice
You expressly acknowledge and agree that:
- AI-generated analysis and Mel AI Chat responses are not a substitute for professional medical or dermatological advice, diagnosis, or treatment.
- SkinStack is not a medical device. It has not been evaluated or approved by any medical regulatory authority (including the MHRA, FDA, or equivalent). It is not intended to diagnose, treat, cure, or prevent any skin condition or disease.
- AI analysis and chat responses may be inaccurate, incomplete, or not applicable to your specific circumstances. AI models can make errors, misread ingredient lists, or generate incorrect assessments.
- You should always consult a qualified healthcare professional or dermatologist before making skincare decisions, particularly if you have a skin condition, known allergies, sensitivities, are pregnant, or are making decisions on behalf of a child.
- Patch testing: Before using any new skincare product, including those identified by the Service, you should conduct a patch test on a small area of skin and wait at least 24 hours for any reaction. You are responsible for patch testing. We are not liable for adverse reactions resulting from failure to do so.
- The AI cannot account for every individual allergy, sensitivity, or medical condition, including those not disclosed in your skin profile. You are responsible for exercising your own judgement before using any product.
- SkinStack does not verify the accuracy of product ingredient lists captured by your camera. Image quality, lighting, or partial capture may affect analysis accuracy.
- Product formulations change. An analysis based on a photographed label may not reflect current formulations.
- Assumption of Risk: By using the Service, you voluntarily assume all risks associated with acting on AI-generated analysis and chat responses. The ultimate decision to use or avoid any skincare product rests solely with you.
- We are not liable for any adverse reactions, skin damage, or health consequences arising from reliance on AI Analysis or Mel AI Chat responses.
6. Subscription Plans and Billing
Plans
- Free Tier: One (1) AI scan per day and up to three (3) Mel AI chat messages per scan result.
- Premium Monthly: £5.99 per month. Unlimited scans, unlimited Mel AI chat, ingredient matcher, routine conflict detection, full shelf audit, wishlist boards, and family profiles.
- Premium Annual: £39.99 per year. Same features as Premium Monthly with a discounted annual rate.
Billing
- Premium subscriptions are billed in advance through the Apple App Store (iOS) or Google Play Store (Android).
- Payments are processed by Apple or Google. We do not store or have access to your payment card details.
- Your subscription will automatically renew unless cancelled at least 24 hours before the renewal date via your Apple ID or Google account settings.
- Prices are displayed in GBP (£). Apple or Google may convert to your local currency.
Auto-Renewal Disclosure
Premium subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription in your App Store or Google Play account settings at any time.
7. Free Tier
The free tier includes:
- Scans: One (1) AI scan per day per account. This limit resets at midnight UTC.
- Mel AI Chat: Up to three (3) Mel chat messages per scan result. Once the limit is reached, users will be prompted to upgrade for unlimited Mel chat access.
We reserve the right to modify, restrict, or discontinue the free tier at any time with reasonable notice. Attempts to circumvent limits (e.g., by creating multiple accounts) are a violation of these Terms and may result in account termination.
8. Cancellation and Refunds
Cancellation
You may cancel your Premium Subscription at any time via your Apple ID (App Store) or Google account (Google Play) settings. Cancellation takes effect at the end of your current billing period, after which your account reverts to the free tier.
Refunds
Subscription payments are non-refundable except where required by applicable law. Refund requests for App Store purchases must be submitted to Apple via reportaproblem.apple.com. Refund requests for Google Play purchases must be submitted to Google via the Google Play Help Centre. We are unable to process refunds directly for purchases made through Apple or Google.
UK and EU statutory rights: If you are a consumer in the UK or EU, you may have a right to cancel within 14 days of purchase, provided you have not already used the Service during that period. By using the Service immediately upon purchase, you acknowledge that you waive this right to the extent permitted by applicable law.
9. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of any third party
- Upload or transmit harmful, offensive, defamatory, or illegal content
- Attempt to gain unauthorised access to our systems or networks
- Use automated tools, bots, or scrapers without our express written consent
- Reverse engineer, decompile, or disassemble the Service
- Create multiple accounts to circumvent free tier limitations
- Resell or commercialise access to the Service without our written consent
- Use Mel AI Chat to seek clinical medical diagnoses or make health decisions that require professional medical consultation
10. Intellectual Property
Our Intellectual Property
The Service, including all content, features, design, and software, is owned by Van Global Ltd and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes.
Your Content
By submitting content (including images of product labels), you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely to provide the Service. We will not use your submitted product images or chat messages for any purpose other than delivering the Service to you.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Third-Party Services
The Service integrates with:
- Anthropic — AI ingredient analysis and Mel AI Chat (Claude AI). Subject to Anthropic's Terms of Service.
- Apple — iOS in-app purchase processing. Subject to Apple's Terms of Service.
- Google — Android in-app purchase processing. Subject to Google Play Terms of Service.
- Supabase — Database and authentication. Subject to Supabase's Terms of Service.
- Resend — Transactional email delivery. Subject to Resend's Terms of Service.
- OpenWeatherMap — Weather data for skin notifications (only if location permission granted). Subject to OpenWeatherMap's Privacy Policy.
We are not responsible for the terms, privacy practices, or conduct of these third-party services.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Van Global Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including any loss of profits, revenue, or data, any adverse skin reactions or health consequences arising from reliance on AI Analysis or Mel AI Chat, or any inaccuracy in AI-generated analysis or recommendations.
Our total liability to you for all claims shall not exceed the greater of: (a) the total amount you have paid to us in the twelve (12) months preceding the claim; or (b) £10.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable UK law.
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses, or that any AI Analysis or Mel Chat response will be accurate, reliable, complete, or timely. We do not warrant that any specific product mentioned in AI Analysis or Mel Chat is safe, suitable, or effective for your individual skin or health condition. Nothing in this section affects any statutory rights you may have as a consumer under applicable UK or EU law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Van Global Ltd from and against any claims, liabilities, damages, costs, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Service in a manner not authorised by these Terms, or your creation or management of Family Profiles including any data you provide about dependants.
16. Termination
By you: You may terminate your account at any time using Settings → Delete Account in the app, or by contacting us at support@skinstack.online.
By us: We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, all rights and licences granted to you will immediately cease.
17. Changes to the Service or These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. For material changes, we will provide at least 14 days' notice where reasonably practicable. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
18. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Jurisdiction
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. If you are a consumer in the UK or EU, nothing in this section affects your right to bring proceedings in the courts of your country of residence.
Informal Resolution
Before bringing any formal legal claim, please contact us at support@skinstack.online. We will make good faith efforts to resolve any dispute within 30 days.
19. Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including acts of God, natural disasters, pandemic, war, government action, industrial dispute, power failure, internet or telecommunications outage, or failure of third-party infrastructure or services (including Anthropic API unavailability, Supabase outages, Apple or Google platform issues). We will endeavour to notify you as soon as practicable and to resume the Service as quickly as reasonably possible.
20. Severability and Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall remain in full force and effect. Our failure to enforce any provision at any time shall not be construed as a waiver of that provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Van Global Ltd with respect to your use of the Service and supersede all prior agreements and representations.
21. Class Action Waiver
To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action. You agree to waive any right to bring or participate in a class action or representative proceeding against Van Global Ltd.
If this waiver is found to be unenforceable, the entirety of this section shall be null and void and the relevant dispute shall be resolved in accordance with Section 18. Nothing in this section limits your statutory rights as a consumer in the UK or EU.
